What is the validity of the agreement ?

When the parties subsequently divorce the Court has the discretion as to how the family assets should be distributed. A separation agreement is one of the factors that the court will take into consideration. If the agreement can be seen to be fair it may be unlikely that the Court will alter its provisions, provided there has been full disclosure of each parties financial circumstances at the time the agreement was entered into.
