They can establish whether it is necessary to obtain a Grant of Probate to allow assets to be collected and distributed in accordance with the wishes of the deceased or to obtain Letters of Administration if there is no Will. The rules regarding intestacy mean that the estate does NOT automatically pass to the surviving spouse if it is over £250,000.
